COMPREHENSIVE RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT:

THIS IS A LEGAL DOCUMENT. BY SIGNING OR OTHERWISE ACCEPTING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
1. ACKNOWLEDGMENT AND WARNING REGARDING RISKS
1.1. Identification of Parties:
This Comprehensive Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement ("Agreement") is entered into by and between SOBER OUTDOORS, INC., a Colorado non-profit corporation (referred to herein as "Company," "We," "Us," or "Our"), and the undersigned individual (referred to herein as "Participant" or "You").
1.2. Inherent Risks of Outdoor Activities:
Participant understands, acknowledges, and agrees that participation in outdoor, adventure, or physical activities (including, but not limited to, hiking, trekking, camping, backpacking, climbing, water activities, winter sports, travel, and any related social events or transportation, hereinafter collectively referred to as "Activities") organized, sponsored, or associated with the Company involves inherent, non-obvious, and significant risks that may result in property damage, severe physical or emotional injury, permanent disability, paralysis, death, or financial loss.
THESE RISKS INCLUDE, BUT ARE NOT LIMITED TO:
Environmental Hazards: Uneven terrain, steep slopes, rockfall, adverse weather conditions (heat, cold, lightning, wind), exposure, limited access to medical facilities, or encounters with wildlife (venomous or otherwise).
Activity-Specific Risks: Physical exertion beyond one's capacity, equipment failure, negligence of other participants, and risks associated with group dynamics or remote locations.
Transportation Risks: Risks associated with travel to and from the Activity location, including vehicle accidents or delays.
1.3. Specific Risk: Recovery and Sobriety:
Participant acknowledges that the Company's mission is centered on providing a sober community. Participation in Activities, especially those in isolated or challenging environments, may cause stress, emotional strain, or psychological triggers that could impact one's recovery or sobriety. Participant assumes all risks related to maintaining their sobriety while participating in the Activities. The Company is not a licensed treatment center, medical provider, or mental health facility, and its staff/volunteers are not sobriety monitors or therapists.
2. ASSUMPTION OF RISK:
Participant VOLUNTARILY elects to participate in the Activities and assumes FULL RESPONSIBILITY for all risks, known or unknown, foreseen or unforeseen, and inherent or otherwise, associated with participation, including those that may be caused by the negligence or fault of the Company.
3. RELEASE AND WAIVER OF LIABILITY:
In consideration of being permitted to participate in the Activities, Participant, for themselves and their heirs, executors, administrators, personal representatives, successors, and assigns (collectively, "Releasing Parties"), hereby RELEASES, WAIVES, AND FOREVER DISCHARGES the Company, its directors, officers, employees, agents, volunteers, successors, and assigns (collectively, "Released Parties") from any and all claims, demands, losses, damages, injuries, or causes of action (including claims for personal injury, property damage, wrongful death, or financial loss) that arise out of or are in any way related to the Participant's participation in the Activities, INCLUDING CLAIMS BASED ON THE NEGLIGENT ACTS OR OMISSIONS OF THE RELEASED PARTIES.
4. COVENANT NOT TO SUE:
Participant covenants and agrees never to initiate, nor to aid or permit to be initiated on their behalf, any legal action or demand for compensation against the Released Parties for any injury, property damage, wrongful death, or loss sustained by the Releasing Parties that arises from or relates to participation in the Activities, which are the subject of this Agreement.
5. INDEMNIFICATION AND HOLD HARMLESS:
Participant agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all losses, liabilities, claims, demands, costs, expenses (including reasonable attorneys' fees), or damages incurred by any Released Party as a result of:
The Participant's negligence, gross negligence, willful misconduct, or violation of Company rules or instructions.
Any and all claims brought by the Releasing Parties, or any third party, that are related to the Participant’s participation in the Activities.
6. MEDICAL FITNESS AND CONSENT:
6.1. Health and Fitness Certification:
Participant certifies that they are physically, emotionally, and medically fit to participate in the Activities, have the proper physical conditioning, and have no medical or mental health condition that could hinder safe participation or pose a risk to others. Participant agrees to discontinue participation immediately if they feel ill, faint, or experience any medical distress.
6.2. Emergency Medical Consent and Costs:
In the event of an emergency, accident, or illness, Participant consents to the administration of first aid, medical care, and transportation by emergency medical personnel or the Company's representatives. Participant assumes sole responsibility for all costs associated with such medical care, treatment, or transport.
7. PARTICIPANT RESPONSIBILITIES AND CONDUCT:
7.1. Compliance with Rules:
Participant agrees to strictly comply with all rules, instructions, and directions given by the Company’s officers, employees, or volunteers, including all safety procedures. Participant acknowledges that failure to comply may result in immediate removal from the Activity without refund.
7.2. Sober Participation Policy:
PARTICIPANT CERTIFIES THAT THEY WILL REMAIN SOBER AND ABSTAIN FROM THE USE OF ALCOHOL AND ALL ILLICIT DRUGS THROUGHOUT THE DURATION OF THE ACTIVITIES. The Company reserves the right to immediately remove any Participant who violates this policy, without refund, and the Participant assumes all costs and liability associated with their removal.
8. GOVERNING LAW AND JURISDICTION:
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to this Agreement or the Activities shall be instituted exclusively in the state or federal courts located in Denver County, Colorado.
9. SEVERABILITY AND ENTIRE AGREEMENT:
9.1. Severability:
If any term or provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other term or provision, and the remainder of this Agreement shall remain in full force and effect.
9.2. Entire Agreement:
This document constitutes the entire agreement between the Company and the Participant concerning the subject matter herein and supersedes all prior agreements, discussions, and understandings, whether written or oral.
BY PARTICIPATING IN ANY SOBER OUTDOORS, INC. ACTIVITY OR ACCESSING THE WEBSITE WWW.SOBEROUTDOORS.ORG, THE PARTICIPANT ACKNOWLEDGES THEY HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND AGREE TO BE BOUND BY ALL OF ITS PROVISIONS. PARTICIPANT FURTHER AFFIRMS THEY ARE OF LEGAL AGE (18 YEARS OR OLDER) OR THAT A LEGAL GUARDIAN HAS SIGNED ON THEIR BEHALF.
MANDATORY SOBER OUTDOORS, INC. OFFICIAL ZERO TOLERANCE POLICY:
Strict Prohibition of Alcohol, Illicit Drugs, and Mind-Altering Substances at All Activities.

THIS POLICY IS THE FOUNDATION OF OUR ORGANIZATION. ANY VIOLATION WILL RESULT IN IMMEDIATE, NON-NEGOTIABLE REMOVAL. SOBER OUTDOORS, INC. TREATS THIS POLICY WITH THE UTMOST SERIOUSNESS.
1. CORE COMMITMENT AND PURPOSE:
1.1. Absolute Standard:
Sober Outdoors, Inc. ("Company") maintains an absolute and unwavering commitment to the sobriety and safety of its community. This Mandatory Zero Tolerance Policy prohibits the possession, consumption, or distribution of alcohol, illicit drugs, and any mind-altering substances (collectively, "Prohibited Substances") during all Company-organized or sponsored activities, events, gatherings, or trips (collectively, "Activities").
1.2. Mission-Critical Rule:
Compliance with this Policy is a mission-critical requirement and a non-negotiable condition of participation. It is essential to preserving the trust, integrity, and safe recovery environment for every individual in attendance, including those new to sobriety.
2. DEFINITIONS AND SCOPE OF PROHIBITION:
2.1. Definition of Prohibited Substances:
Prohibited Substances include, but are not limited to, the following categories:
Alcohol: Any beverage, liquid, or product containing any percentage of alcohol by volume.
Illicit Drugs: Any substance classified as a controlled substance under federal, state, or local law.
Impacting Agents: This category includes cannabis/marijuana (regardless of medical card status or local legality), synthetic stimulants, dissociative substances, and any other substance (including over-the-counter or herbal preparations) taken or used to achieve an altered state of mind, affect judgment, or compromise sobriety.
2.2. Strict Exception for Prescription Medication:
The only exception is for medication that is:
Personally prescribed to the Participant by a licensed medical professional for a current, necessary condition.
Carried and administered strictly according to the prescription label.
Mandatory Disclosure: If the legally prescribed medication may cause visible impairment (e.g., drowsiness, dizziness), the Participant MUST inform the Activity lead organizer prior to the start of the Activity. Failure to disclose may still lead to removal if impairment is observed.
2.3. Scope: 24/7/365 Duration:
This Policy applies comprehensively to the Participant from the official start time of the Activity until the official end time of the Activity, covering:
The entire physical location of the Activity (e.g., trail, boat, campsite, lodging).
Any and all personal belongings, gear, and vehicles brought by the Participant to the Activity area.
All organized transportation associated with the Activity.
3. IMMEDIATE ENFORCEMENT AND CONSEQUENCES:
3.1. Zero Tolerance and Immediate Removal:
The Company has established a ZERO TOLERANCE standard. There is no warning, probationary period, or second chance.
Any Participant found, by the reasonable assessment and judgment of a Company organizer or staff member, to be in violation of this Policy (including evidence of possession, consumption, distribution, or exhibiting visible signs of impairment) SHALL BE IMMEDIATELY AND PERMANENTLY REMOVED from the Activity.
3.2. Investigation and Determination:
The decision to remove a Participant rests solely with the lead Company organizer on site. The organizer's determination is based on their observation or credible report and is final and non-negotiable.
3.3. Mandatory Financial and Logistical Burden:
The violating Participant accepts FULL AND UNQUALIFIED RESPONSIBILITY for all costs and complications arising from their mandatory removal, including but not limited to:
The cost of immediate and secure third-party transportation (e.g., taxi, shuttle, or vehicle retrieval) from a potentially remote location.
Any costs incurred by the Company related to the disruption, including staff time or logistical changes.
FORFEITURE OF FEES: The Participant irrevocably forfeits any and all registration fees, deposits, or payments made for the Activity.
NO REFUNDS WILL BE ISSUED.
3.4. Safety and Legal Intervention:
If the violation involves a risk to public safety, the possession of illegal narcotics, or behavior that compromises the security of the group, the Company WILL immediately contact local law enforcement and/or emergency medical services.
4. PARTICIPANT ACKNOWLEDGEMENT:
By registering for or participating in any Sober Outdoors Activity, the Participant provides EXPLICIT AFFIRMATION that they:
1) Have read and fully comprehended the severe nature and terms of this Zero Tolerance Policy.
2) Acknowledge that any breach of this Policy is a fundamental violation of the Sober Outdoors mission.
3) Consent to immediate, mandatory removal and forfeiture of fees should a violation occur.
